Daily Nation, Nairobi, 25 November 1999Jailbird sentenced to 26 yearsBy Watoro Kamau A 60-year-old jailbird was yesterday jailed for 26 years for defiling two minors and infecting them with a venereal disease. Musa Mohamed Mendoh, who has 19 previous convictions, was convicted by Molo Senior Resident Magistrate Joshua Kiarie who also ordered that he receive 24 strokes of the cane. Mendoh, who was unrepresented, yesterday told the court that he had nothing to say in mitigation. He was charged with two separate counts of defiling two under-age girls on August 28 within Molo Township. Mendoh was also charged with two separate counts of infecting the complainants with a venereal disease. The accused also faced a fifth count of failing to seek medical attention when he was aware that he was suffering from an infectious disease. The magistrate ordered that he serve a 12 year-jail term on each of the two counts of defilement, and receive 12 strokes for each of the counts. Mr Kiarie also ordered that the jailbird to serve a one-year prison term on each of the two counts of infecting the complainants with a venereal disease and another three months for failing to seek medical attention. Before the sentence was passed, the prosecutor read to the court Mendoh's previous criminal record which the accused confirmed as true. |
