Ainur Asyriq Aizamuddin, 19, took eight strokes of the rotan on his buttocks in the Ampang Sessions Court following his admission of guilt to the offence. Under Section 293(1)(c) of the Criminal Procedure Code, the Court has discretion to order a youthful male offender to be whipped up to 10 times, instead of being sent to prison. Judge Manira Mohd Nor also ordered that Ainur Asyriq serve three months of community service, under Section 5(1) of the Compulsory Attendance Act 1954, a provision which gives an alternative to prison time. Ainur Asyriq had originally claimed trial to two counts of raping the teenage girl but on May 14, changed his plea and admitted to the crime. The offences occurred at an apartment in Estana Court, in Ukay Bestari, Ampang Jaya on Nov 19 and Dec 7, 2013. Ainur Asyriq served the whipping sentence in front of a doctor, his parents and a group of observers. As he was a youthful offender, a thin rotan (the type used for punishing white collar criminals) was used. Despite wearing jeans, Ainur Asyriq was seen flinching each time the policeman readied to whip him. He was heard groaning in pain and appeared to be holding back tears after the fifth strike. Karim KUALA LUMPUR: A college student who pleaded guilty to raping his 15-year-old girlfriend last year, yesterday underwent light caning at the Ampang Sessions Court in open court and in the presence of his parents. Judge Manira Mohd Nor said she hoped Ainur Ashriq Aizamuddin, 18, would take the punishment as a lesson and to never commit the offence again. Ainur wailed in pain when he received eight strokes from a Kajang Prison officer. On Dec 13 last year, he was charged with two counts of raping the girl in a house at Ukay Bestari, Ampang Jaya here, about 9am on Nov 29, 2013, and at the same place about 4pm on Dec 7. When Ainur pleaded guilty on May 14, he was sentenced to do compulsory community service under Section 5 (1) of the Offenders Compulsory Attendance Act 1954 for the first charge. He was bound over in the sum of RM1,000 with one surety and ordered to do community service four hours a day, everyday for three months, beginning from the date of sentencing. On the second charge, he was sentenced to eight strokes of light caning in public under Section 293 (1)(c) of the Criminal Procedure Code for youthful offenders. Manira said parents should be more aware of their children's social life and try to take control of it. "This is only light caning. If it is normal caning it will be 10 times more painful. The punishment for Asyriq Aizamuddin Ainur, 19, was carried out by officers from Kajang Prison in front of the Judge, Manira Mohd Nor, and was witnessed by members of the public in the public gallery, including journalists. The light whipping under Section 293(1)(c) of the Code of Criminal Procedure was for the second charge he faced. Before the caning, the court asked the doctor in attendance to check the health of the young offender and as the diagnosis was healthy, the punishment began. The slim accused, wearing a shirt and blue jeans, groaned in pain under the light cane, which was about one metre long. -- Berita Harian Corpun file 25402 at www.corpun.com The Borneo Post, Kuching, 19 June 2014 Three years' jail, two strokes for cheating SIBU: A 23-year-old man was sentenced to three years in jail and two strokes of the cane by a Magistrates' Court here yesterday after he pleaded guilty to cheating and dishonestly inducing delivery of property. Jason Sim was charged under Section 420 of the Penal Code, which carries a jail term not less than one year but not more than 10 years, whipping, and a possible fine. He committed the offence in front of a hotel in Mission Road about 10am on June 5. He deceived one Kong Ting Chuo into handing over to him RM450 for changing to RM10 notes.
