Mohd Nazrin, 21, a despatch rider, was yesterday found guilty of two counts of raping the teenager in a bush area near Kampung Sungai Bakau in Gombak on April 3 last year. Ampang Sessions Court judge Roszianawati Ahmad said Mohd Nazrin was a cruel person, having stopped the victim while pretending to be a policeman and taking her to a secluded area, before raping her repeatedly. "You called your friends to watch the rape. Before that, you forced her to strip by threatening that you'll have your friends rape her as well if she did not comply. "She repeatedly begged you not to hurt her and you still raped her ... twice," said Roszianawati. The judge said she believed the testimony of the victim, adding that the chemical analysis and rape test substantiated her claims. The victim also gave an impact statement in court, from behind a screen as she is a minor, telling the court how the incident deeply traumatised her. "I've stopped my studies. I am too embarrassed to go to school," she said. The judge repeatedly asked if the victim was able to continue, as the victim sobbed loudly while reading her statement. Her family members, who attended the proceedings, were also seen on the verge of tears during the reading.
Counsel Mohd Yusoff Ag Lah had pleaded in court that his client be given a bond of good behaviour, considering his age and the fact he was a first offender. "My client is also the sole breadwinner to his wife and two children. If he were to go to jail, his family would be gravely affected," he said. He referred to the cases of former national youth squad bowler Noor Afizal Azizan, 21, and electrician Chuah Guan Jiu, 22, who were bound over for good behaviour after committing statutory rape. DPP Noor Fadzlin Abd Zawawi objected to the request for a bond, saying that while Mohd Nazrin was only 20 years-old at the time of the offence, he should have been more responsible as he had a family. "In those cases, the accused had committed statutory rape with their girlfriends. Mohd Nazrin forced himself on to a stranger, whom he had abducted and raped, together with an accomplice," she said. Roszianawati, while rejecting the request for bond. ruled that a deterrent sentence was necessary. She sentenced Mohd Nazrin to 25 years' prison and eight strokes for the first charge and 25 more years and 10 strokes for the second, with the sentences to run concurrently.
