A 15-year-old boy will receive three strokes of the cane after
he fondled the breasts of his neighbour's 12-year-old daughter.
The teenager from Beatrice had denied the charge of indecent
assault when his trial opened before Chitungwiza magistrate Mr
Kudakwashe Jarabini on Friday last week. Prosecutor Mr Edmond Ndambakuwa proved that on October 15 last year the minor was playing with the boy's sister at their residence. The sister later went inside the house, leaving the girl with the teenager. The boy took advantage of his sister's absence and advanced towards the girl and fondled her breasts and went away. The girl disclosed the matter to her teacher who informed her parents. The parents reported the matter to the police leading to the boy's arrest. Another teenager from Chitungwiza was told he will receive three strokes of caning for raping his nine-year-old niece. The 14-year-old boy had denied a rape charge when he appeared before Chitungwiza regional magistrate Ms Estere Chivasa recently. He was, however, convicted after prosecutor Mr Luke Mutupe proved a case against him. Ms Chivasa ordered the boy to receive corporal punishment of three strokes that should be administered by health personnel at Harare Central Prison. In addition, the boy had a wholly suspended three-year jail term on condition of good behaviour. A Chitungwiza teenager who fondled a neighbour's 12-year-old daughter after being offered a place to sleep has been sentenced to receive three strokes of the cane. The 16-year-old boy was facing two counts of rape when he appeared before Chitungwiza regional magistrate Ms Estere Chivasa. He was however convicted of a competent verdict of aggravated indecent assault charges after prosecutor Ms Joice Fusire failed to prove a case of rape at the end of the trial. The boy denied the allegations claiming to have been in love with the girl. The boy also told the court that he had failed to be intimate with the girl after being disturbed before the act. In assessing the sentence, Ms Chivasa noted that the boy was disrespectful by fondling the girl's breasts in her parent's house. She said that it was very disturbing to learn that the two parties were assaulted by police officers. She said this could have forced the teenagers to admit having had sexual intercourse. A 14-year-old boy will receive two strokes of the cane after pleading guilty to raping his four-year-old niece while her mother was in another room. Chitungwiza regional magistrate Ms Estere Chivasa said the boy did not qualify for a custodial sentence and ordered that he receives corporal punishment. In addition, Ms Chivasa imposed a one-year prison term of imprisonment on the juvenile, which was suspended conditionally for five years. In sentencing him, Ms Chivasa took into account that the girl would be traumatised for life and that the boy showed some contrition by pleading guilty. Agreed facts were that on October 9 in 2011, and at around 12pm, the minor was playing outside the house while her mother was in her bedroom. The boy called her into another room where he raped her. The girl's mother discovered the offence when she saw some blood drops on the floor. She asked her daughter what had happened and she revealed the offence.
