Theft and mischief case: Two juveniles jailed

JUVENILE defendants were sentenced yesterday after they pleaded guilty earlier to committing theft and mischief offences before Senior Magistrate Pg Masni Pg Hj Bahar in the Magistrate's Court who were charged along with two other adult defendants.
The prosecution asked the two juvenile offenders to be tried in the adult court reflecting the degree of involvement in the offences and the gravity of the seriousness of the offences.
The 33-year-old local man, Talip bin Hj Jofri, pleaded guilty along with the two juveniles towards charges of theft, housebreaking, misappropriation and mischief was sentenced to imprisonment for three years and six months with two strokes of the cane. The Magistrate's Court adjourned making decision on the two juvenile boys.
Thirty-one-year-old Raddyman bin Awg Hj Radin, released on bail of $5,000 or in one local surety, denied all seven charges of theft and mischief and will go for trial. The 16-year-old was sentenced to 16 months' imprisonment while the 17-year-old offender was given 18 months' imprisonment with two light strokes of the cane.
Statement of facts revealed that Talip brought his car and drove to Restaurant Bahagia Teratur in Kg Kiarong bringing the 16-year-old boy in the wee hours of December 9 and 10, 2012.
The defendants broke into the restaurant by entering through the back door which Talip had pried open.
Talip and another person then stole a 32" television set, a gas cylinder, a water dispenser, an electric drill and an Astro Beyond receiver and its card belonging to the restaurant. Talip, the 17-year-old defendant and another person, on the second count, went to a house at Kg Mata-Mata using Talip's father's car on December 15, 2012.
On arriving, they managed to cut the padlock on an iron fence of the front door, pried the door open and entered the house. They then left the house taking with them a 32" television set with remote control, a laptop with its charger and two speakers.
The third count states that the defendants involved in the third charge had committed mischief by causing damage to the home owner's property.
On the fourth count, Talip alone stole a parabola satellite dish from Flat JPA in Kg Kiarong during the wee hours of November 5 and 6, 2012.
The 16-year-old defendant was withdrawn from facing this fourth charge amounting to an acquittal. The fifth charge states that Talip and both of the juvenile defendants stole a parabola satellite dish from a flat in Kg Kiarong on November 17, 2012.
The sixth charge states that Talip and the 17-year-old defendant dismantled and took a parabola satellite dish from the compound of Aprina Enterprise some time in September 2012 and is an offence of dishonestly misappropriating property.
The seventh charge states that Talip and the 17-year-old defendant again dishonestly misappropriated property by dismantling and taking away a parabola satellite dish from the compound of Telanai Heights some time in October 2012. Deputy Public Prosecutor Ak Shahyzul Pg Abd Rahman prosecuted the case.
