Drug trafficking: Duo get life jail, whipping

Kota Kinabalu: Two men who were found guilty of trafficking drugs were sentenced to life imprisonment plus whipping by the High Court here Thursday.
Judge Datuk Nurchaya Arshad, in delivering her decision, held that the prosecution had proven its case beyond reasonable doubt in both cases.
Cook Noel Harry Hungan, 30, and Mohd Izzan Azhar Abdullah, 22, were found guilty as charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952 and convicted and sentenced in accordance with the Dangerous Drugs (Amendment Act 2017), held Nurchaya.
Noel was convicted on two counts of trafficking 2,811gm of cannabis at 5.40pm on May 10, 2016 near the toilet area at Poslaju office here and trafficking 3,768gm of cannabis at 10.45am on May 11 the same year at the AirAsia Cargo area here.
The court sentenced Noel to life imprisonment and ordered him to be caned 15 times on each charge.
Nurchaya ordered the sentences to run concurrently.
Mohd Izzan was also sentenced to life imprisonment and ordered to be given 15 strokes of the cane.
He was convicted of trafficking 6,626gm of cannabis at 10pm on Sept 14, 2016 in Kepayan, here.
Both Noel and Mohd Izzan had opted to give evidence under oath in their defence.
The charge, under the new amendment, provides that any person found guilty of trafficking dangerous drugs can be punished with either the death penalty or life in prison and whipping with a minimum of 15 strokes.
Deputy Public Prosecutor Gan Peng Kun appeared for the prosecution.
Noel was represented by counsel Dato' Seri Rakhbir Singh while Mohd Izzan was defended by counsel Zahir Shah.
