A 44-YEAR-OLD divorced man with five children including an adopted child was sentenced to jail for 17 years with 12 strokes of the cane by Justice Dato Paduka Steven Chong in the High Court yesterday on six charges of rape, outraging modesty and having unlawful sexual acts with his daughter and niece, both underaged at the time of offences. The man's identity cannot be revealed to protect the victims' identities. On January 26, 2013, as everyone in the house was fast asleep, he had sex with his daughter who did not resist as she was afraid of him. On his daughter's 14th birthday in August 2012, the defendant told her that if she agreed to his sexual advances he would let her off from having to go to school. The ordeal continued in August and September 2009 even during the fasting month. The defendant also outraged the modesty of his 12-year-old niece at home once and another time in his car at the basement parking of a shopping mall. The defendant's offences were eventually exposed when his niece told about it to her school counsellor and was reported to JAPEM. THREE foreign nationals were sentenced yesterday by the Bandar Seri Begawan Magistrate's Court following their guilty pleas to charges of overstaying in the country. Senior Magistrate Muhammed Faisal PD Hj Kefli sentenced 34-year-old Vietnamese man Nguyen Huu Phong to jail for three months with three strokes of the cane for remaining in the country illegally after the expiry of his employment pass. Phong surrendered himself to the Immigration's Enforcement Section on March 12, 2013, asking for his repatriation. Investigations revealed that Phong was a runaway worker and he admitted that he had worked illegally as a construction worker with various companies. Meanwhile, 41-year-old Indonesian man Uso received three months' jail with three strokes of the cane for overstaying on the expiry of his visit pass. Uso was arrested in a raid while he was working at a vegetable stall on March 12, 2013. He was asked to produce his passport and failed to do so. Investigations showed that Uso entered the country as a visitor and had extended his visit pass by re-entry from time to time.
