Robbers get nine years' jail, caning

KUCHING: The Sessions Court here yesterday sentenced two men to nine years in jail and two strokes of the rotan after they pleaded guilty to robbing an elderly man and his wife in Serian last month.

Awang Ekhsan Awang Ahmat, 22, and Mohammad Razzie Roslan, 27, appeared before Judge Amernudin Ahmad, who imposed the custodial sentence after he took into consideration the nature of the offence, public interest, as well as their mitigation.

Two other accused, both 17-year-olds, who also admitted to the same offence were each released on RM2,000 bail with their parents as surety pending sentencing following probation reports from the welfare officer.

All four accused admitted to robbing a 67-year-old victim in front of a house at Mile 37 Kuching-Serian road on Jan 25.

The brief facts of the case read to the court by DPP Harun Najmi stated that the four were riding on two separate bikes when they saw the victim and his wife walking towards a car in front of a house.

All four approached him, with Razzie and one of the juveniles holding on to the victim from behind and asking for his money.

When the victim refused to comply, there was a struggle between him and the four suspects, which saw him knocked unconscious.

Awang Ekhsan then drove off in the victim's car followed by his accomplices on motorcycles, leaving the victim and his wife by the roadside.

On Jan 27 around 7pm, police from Serian arrested Awang Ekhsan and Razzie when they surrendered themselves at the police station.

The two juvenile accused were arrested on the same day at Kampung Baru Semariang here.

Under Section 395 of the Penal Code, robbery provides for a prison term of up to 20 years and whipping.

None of the four were represented by defence counsel.
